Friends of Evan Sorce, PAC #23780 (“we,” “us,” or “our”), operates evansorce.org and any campaign online services linking to these terms (“Sites”). By accessing or using the Sites, you agree to these terms. If you disagree, don’t use the Sites. Questions may be sent to info@evansorce.org.
We grant a limited, revocable, nontransferable, nonsublicensable license to use the Sites and their materials for personal, informational, noncommercial purposes. Unless expressly permitted, you may not resell, reproduce, distribute, publicly perform or display, modify, create derivative works from, or download materials beyond normal browser caching. No other intellectual property license is granted. Unauthorized use terminates this permission.
You may not impersonate others; misrepresent affiliations; scrape, harvest, or collect user information without authorization and any required express consent; overload or disrupt systems; probe or breach security; introduce harmful code; reverse-engineer software; send spam or unauthorized advertising or campaign promotions; harass users; or engage in unlawful conduct or conduct that restricts others’ use or exposes others to harm or liability. We may investigate violations, cooperate with law enforcement, and suspend or block access or terminate your license at any time, without notice, in our discretion.
The Sites may link to or include outside content and services, including donation processing, event registration, and volunteer tools. We don’t endorse or accept responsibility for their content, accuracy, reliability, security, privacy practices, products, services, activities, or events. Your dealings with outside providers are between you and them; review their terms and policies.
We may communicate electronically about the Sites and campaign as permitted by law and your communication choices. Visiting the Sites alone doesn’t enroll you in text messages.
By affirmatively subscribing, you consent to recurring campaign texts, including automated messages, about campaign updates, events, volunteering, voting, and fundraising. Message frequency varies. Message and data rates may apply. Consent isn’t a condition of contributing, volunteering, or supporting the campaign. Reply STOP to unsubscribe or HELP for assistance, or contact info@evansorce.org. Neither the campaign nor participating carriers guarantee delivery; carriers aren’t liable for delayed or undelivered messages. We may discontinue the program without notice.
Our Privacy Policy, available through the website’s Privacy Policy link, explains our information practices and mobile information protections. Don’t provide another person’s personal information unless you have the rights required by law and have shared our Privacy Policy with them.
Feedback, questions, comments, suggestions, ideas, and other materials submitted about the Sites or campaign are nonconfidential and become our property. To the extent you hold rights in these materials, you assign those rights, including intellectual property rights, to Friends of Evan Sorce, allowing unrestricted use and distribution without acknowledgment or compensation. Personal information remains subject to our Privacy Policy.
You agree to defend, indemnify, and hold harmless Friends of Evan Sorce, its contractors, providers, consultants, joint committee members, and their respective subsidiaries, affiliates, directors, officers, employees, volunteers, assigns, and agents against losses, claims, threatened or actual proceedings, demands, damages, liabilities, costs, and reasonable attorneys’ fees arising from your use of the Sites, submitted content, acts or omissions relating to the Sites, or alleged violations of these terms or others’ rights.
Except as expressly agreed in writing, the Sites, materials, and related services are provided “as is,” at your own risk, without express or implied warranties, including merchantability, fitness for a particular purpose, title, or noninfringement. We don’t guarantee accuracy, completeness, reliability, currency, uninterrupted operation, or freedom from errors, viruses, or harmful components. Use appropriate security software for downloads. We may change content or services without notice.
To the fullest extent permitted by law, the campaign and its subsidiaries, affiliates, directors, officers, employees, agents, assigns, and volunteers aren’t liable for direct, indirect, special, consequential, punitive, or other damages, including lost use, profits, or data, arising from the Sites, related services, materials, or these terms. This includes reliance on content, errors, interruptions, deleted files or emails, viruses, delays, communications failures, theft, unauthorized access, and other performance failures, even if advised of possible damages and regardless of legal theory, including negligence. Aggregate liability won’t exceed the greater of $100 or the amount you paid to access the Sites. These exclusions and limits apply only where legally permitted.
Oregon law governs these terms without regard to conflict-of-law rules. You consent to exclusive jurisdiction and venue in Oregon state and federal courts for disputes arising from these terms.
These terms constitute the entire agreement concerning the Sites and supersede earlier communications and proposals. If a provision is unenforceable, the remainder continues, and the provision will be replaced with an enforceable one closest to its intent. No partnership, employment, agency, or joint venture is created. Failure to enforce a provision isn’t a waiver. Nothing limits our compliance with lawful governmental, court, or law-enforcement requirements.
We may revise these terms by posting an updated version and revision date. Changes take effect upon posting, subject to applicable law; continued use confirms acceptance. Review these terms periodically.
